ASSAULT

Did you know that even touching someone can result in a charge of assault.  Its true.  In the State of Arizona it is an assault if any person 1)intentionally, knowingly or recklessly causes any physical injury to another, or 2)intentionally places another in reasonably apprehension of imminent physical injury or; 3)knowingly touches another person with the intent to injure, insult or provoke such person.  You can find the full text in ARS 13-1203.  As such it is important never to strike another person in the heat of an argument.  We see these kinds of cases whenever a divorce proceeding is pending.  One spouse will insult an alleged victim spouse and grab them by the arms. Ultimately the police are called and someone always gets arrested.  Be careful and mindful of what constitutes an assault in this state especially if you are going through divorce proceedings.
