Holding: The 9th Circuit panel affirmed a judgment revoking supervised release in the case of a defendant who concedes that he became a fugitive in October 1995.

The panel held that the defendant's arrests by Minnesota state authorities between 1996 and 2007 neither support an inference that federal authorities had actual knowledge of his presence nor impute constructive knowledge to them, and that the defendant's term of supervision was therefore tolled until federal authorities arrested him in 2009, such that the district court had jurisdiction to revoke his supervised release and impose a prison sentence.
