When is DUI a felony?
Under Arizona law, a DUI is usually charged as a misdemeanor, as mentioned. However, an aggravated DUI or extreme DUI can both merit a felony charge.
Factors that can enhance a DUI to a felony include:
- The presence of a child under 15 years old in the car
- Having two prior DUI convictions within seven years of current DUI charge
- Driving with a suspended or revoked licenses during the arrest
- DUI arrest after a judge required the installation and use of an ignition interlock device
Any of these factors can raise your DUI to a serious felony, which carries at least two and a half years in jail. Any third DUI you receive within seven years will also be considered an aggravated DUI which is an automatic felony charge. This carries at least 4 months in prison but upwards of 3 years, fines of $5,500, a revocation of your driver's license for 3 years, probation for up to 10 years, mandatory drug or alcohol evaluation and treatment program, and a possible impounding of your vehicle at your expense.
